The substances used at Life Retreat are legal in Ecuador for traditional and ceremonial use. This is not a workaround. It is the position of Ecuadorian constitutional and pharmaceutical law. What follows is the complete legal context — what it means, what it does not mean, and what to know.

In Ecuador

Legal under three frameworks.

Ecuadorian law recognises plant medicines under religious freedom, traditional indigenous practice, and pharmaceutical exemption.

The Republic of Ecuador is one of a small number of countries in which ayahuasca, San Pedro, and naturally occurring psilocybin mushrooms are legal for traditional ceremonial use. This is not an oversight, a loophole, or a regulatory gray zone. It is the active and explicit position of Ecuadorian law, supported by the 2008 Constitution and reinforced by subsequent rulings.

Constitution of Ecuador · Article 57.4 · 2008
"The State guarantees the conservation and promotion of biodiversity practices and ancestral knowledge connected with their environment. It recognises and guarantees their rights to maintain, protect and develop the collective knowledge of their sciences, technologies and ancestral wisdom."

Three legal frameworks support our work:

Religious and ceremonial freedom. Article 66 of the 2008 Constitution guarantees freedom of religion and conscience. Plant medicine ceremonies in indigenous tradition are protected forms of religious expression.

Indigenous traditional rights. Article 57 specifically protects ancestral knowledge and traditional practice. Life Retreat holds a partnership agreement with the Sápara Nation, recognised by the Ecuadorian Council of Indigenous Nationalities.

Pharmaceutical exemption. Ecuadorian Pharmaceutical Law (2014) explicitly excludes ayahuasca and Wachuma from the controlled substances schedule when used in traditional ceremonial context. Mushrooms in the genus Psilocybe occur naturally in Ecuador and are not scheduled under the same law.

What this means in plain language: if you are a foreign visitor coming to Ecuador to participate in a ceremony at Life Retreat, you are not breaking Ecuadorian law. The retreat is operated under a registered legal entity (Life Retreat Ecuador S.A.), with annual permits from the Ministry of Health (Acuerdo Ministerial 5577) and the Ministry of Tourism.

Where the work is held

Status by country.

The work is in Ecuador. The country status table below is for reference about your country of citizenship.

The substances themselves are scheduled differently in different countries. Below is a non-exhaustive reference. The legal status of the medicines outside Ecuador does not affect the legality of your participation in the retreat itself, but it may affect what you can do when you return home.

A clarification on travel

You will not bring substances back from Ecuador. There is nothing to declare at customs. The substances stay in Ecuador. What returns home with you is your experience, your integration practice, and the long work of remembering.

Travel & customs

Crossing borders, plainly stated.

What to know about getting to Ecuador and getting home — the practical matters.

Visa requirements (most participants). Citizens of the United States, Canada, the European Union (including Romania), the United Kingdom, Russia, Israel, and most Commonwealth countries do not require a visa for stays under 90 days. Your passport must be valid for at least 6 months from your arrival date.

Customs on arrival in Quito. Standard customs declaration. You are arriving as a tourist for a wellness retreat. If asked, that is exactly what you are doing — and it is true. You are not doing anything illegal under Ecuadorian law.

Departure from Ecuador. Likewise standard. There is nothing in your luggage. You will not, under any circumstances, attempt to bring substances out of Ecuador. We have refused requests to do so consistently for eight years.

Layovers in countries with stricter laws. Many flights from Quito connect through Bogotá, Panama City, Madrid, Amsterdam, or Miami. Layover transit is not customs entry — your luggage stays in transit. There is no concern.

Return to your home country. If you live in a country where the substances are scheduled, your participation in a legal ceremony in Ecuador does not become illegal when you return home. You are not bringing anything with you. The medicine has done its work.

What about microdosing or future use at home? That is your question, your jurisdiction, and your responsibility. We do not provide substances for take-home, and we cannot offer advice about non-Ecuadorian use. The S2S integration container does not depend on any further substance work.

Drug testing for employment. Standard 5-panel and 10-panel drug tests do not test for DMT, psilocybin, or mescaline. The standard tests are calibrated for amphetamines, cocaine, opioids, cannabis, and barbiturates. Specialised psychedelic panels exist (used in research and some licensing contexts) but are not part of standard employment screening.

Insurance & liability

Coverage and limits.

What our insurance covers, what travel insurance is recommended, and the limits of both.

Our liability insurance. Life Retreat Ecuador S.A. holds a $5M USD professional liability and premises insurance policy with QBE Latin America. This covers premises liability, professional negligence, and emergency medical evacuation costs incurred during the retreat.

What our insurance does not cover. Pre-existing medical conditions you did not disclose. Injuries arising from substance interactions you did not disclose. Activities outside the retreat property.

Travel insurance (required). All participants must carry travel medical insurance with minimum $250,000 USD coverage and air-evacuation provision. We recommend World Nomads Explorer Plan or IMG Patriot. We can provide a list of providers familiar with our retreat protocols.

Travel insurance disclosure. When purchasing travel insurance, you do not need to disclose the substance content of the retreat. You are travelling to Ecuador for a wellness program, which is true. The legal classification of your activity in Ecuador (legal) is what is operative. We have eight years of insurance claims experience and have never had a claim denied for misrepresentation.

Mental health pre-existing conditions. If you have a pre-existing mental health condition, declare it on your travel insurance. We are happy to provide letters from our medical staff confirming the screening process. Hidden conditions are not covered. Disclosed conditions usually are.

Frequent legal questions

What people actually ask.

Questions we receive often, answered plainly.

Will participating in this retreat affect my employment, security clearance, or professional license?

In most cases, no. Standard employment drug screens do not test for these substances. Security clearances and professional licenses are jurisdiction-specific — if your work involves a federal security clearance (e.g., US Department of Defense), or you hold a license with mandatory disclosure (medicine, law in some jurisdictions), seek your own counsel. We have served thousands of physicians, attorneys, executives, and military veterans without issue.

Can I write about my experience publicly when I return home?

Yes. Many of our alumni do. Public writing about a legal ceremony you participated in legally in Ecuador is protected speech in most jurisdictions. We ask only that you not name other participants without their consent and do not photograph the maloca during ceremony.

What if I am asked at US customs whether I have used controlled substances?

This is a legitimate question, and US customs officers are not your friends. The honest answer for most participants is "yes, in a religious / ceremonial context, in a country where it is legal." US Customs and Border Protection has, on rare occasions, denied entry to non-citizens on the basis of admitted past drug use. If you are a non-US citizen with a pending US visa application, this is worth thinking about. We do not recommend lying. We recommend speaking with an immigration attorney before travel if this concerns you.

Is the retreat itself legally registered?

Yes. Life Retreat Ecuador S.A. is registered with the Superintendencia de Compañías (RUC: 1792XXXXXXX). Our annual permits include Ministerio de Salud Pública Acuerdo 5577 (health), Ministerio de Turismo registration (tourism), and Sápara Nation collaboration agreement (indigenous partnership). We file annual taxes in Ecuador and pay all applicable contributions.

What if Ecuadorian law changes?

If the legal framework changes, we will say so publicly and we will pause operations until the legal status is clear. We have worked with Ecuadorian counsel for eight years and follow legislative process closely. There has been no movement toward restricting these protections; the recent direction has been toward strengthening them.

Can I sue the retreat if something goes wrong?

Yes. We carry insurance precisely so this is possible. Our terms of participation are governed by Ecuadorian law and include a mediation clause before litigation. We have never, in eight years, been the subject of a legal claim. We mention this not as marketing — but because the option exists, and you should know it exists.
